Heidi Alexander Challenges Regulator Over Air Traffic Failure Compensation

Transport Secretary Heidi Alexander has told Parliament that the recent air traffic control failure across the United Kingdom was “not unavoidable,” creating a direct policy conflict with aviation regulators currently shielding airlines from paying compensation to hundreds of thousands of stranded travelers.

The technical glitch, which originated at National Air Traffic Services’ (NATS) Swanwick control site, led to more than 2,000 flight cancellations over a two-day period. While Alexander has labeled the incident as a failure that could have been prevented, the Civil Aviation Authority (CAA) has maintained that the outage constitutes “extraordinary circumstances.” Under current regulations, this classification means that the approximately 300,000 affected passengers are unlikely to be entitled to financial compensation for their delays.

Investigations and Deadlines

In response to the disruption, the government has initiated a dual-track investigation to determine the root cause of the system failure. Heidi Alexander has ordered the CAA to conduct an independent review, which is expected to deliver its findings in six months. However, a more immediate deadline has been set for NATS leadership.

NATS Chief Executive Martin Rolfe has been given exactly one week to submit a preliminary internal investigation report to the Department for Transport. While NATS has already ruled out a cyberattack as the cause, the report is expected to detail why the flight processing system failed at the Swanwick facility and why backup protocols did not prevent a total shutdown of the network.

The scale of the failure has drawn sharp criticism from the airline industry. Ryanair has led calls for Rolfe’s immediate resignation, with the airline’s leadership describing him as an “overpaid failure” and citing this as a recurring issue for the national air traffic provider.

Political Friction Over Leadership

Despite the Transport Secretary’s sharp assessment of the failure as “avoidable,” a divide has emerged within the government regarding the future of NATS management. A spokesperson for Prime Minister Andy Burnham stated that the government currently retains confidence in Martin Rolfe, resisting the calls for his dismissal from major airline stakeholders.

The outcome of the one-week internal report and the subsequent six-month CAA review will likely determine whether that confidence remains. For passengers, the immediate focus remains on the legal definition of the event. If the independent review aligns with Alexander’s view that the failure was avoidable, it could pave the way for a legal challenge against the “extraordinary circumstances” ruling that currently blocks payouts for those caught in the travel chaos.
